A 36 year old woman of Kamboli village in Chief Mwase’s area of Lundazi district today testified in the Chipata High Court how she threw her newly born baby in the toilet.
This is in a matter where Nelis Nkhoma is charged with one count of murder.
Facts before the courts are that Nkhoma on dates uknown but between 30th March and 1st April 2017, in Lundazi did murder her newly born baby by throwing her in the toilet.
But Nkhoma who is represented by Legal Aid Board Counsel Sally Bwalya denied the charge saying that the baby accidentally fell in the toilet.
She said that the labour started when she went to answer the call of nature in the and had an epileptic attack when she was giving birth in the toilet.
She told the court that the baby might accidentally fell in the toilet because she did not what was happening as she was under an attack.
And when she was asked as to why she did not call for help after the attack and that she was no longer pregnant, Nkhoma told the called that she could not narrate what happened to anyone because she was afraid that her her husband might bit her up.
The matter has since been adjourned to a later date for judgement to allow the prosecution’s and the defense lawyers to give written submissions to the court.
